Sometimes, even though we really did not expect it, divorce happens. When it does happen, we want to be sure that we are completely ready to move on with our lives. This means, after a divorce, we should take a good look at our finances and credit. Sometimes, even after we have gone through all the right channels in filing for divorce, we will still have "leftovers" that we need to deal with; this is where your divorce papers will come in handy. This is particularly true when it comes to your personal credit, finances, and even getting married again, later on down the road. Personal Credit After divorce, you will likely need to obtain certified copies of your divorce records, in order to provide proof to creditors that you are legally divorced. You see, if later you are wanting to purchase a new car or home, the creditor may find some instances of your previous spouse on your credit, which could hurt your chances of being approved. If this were to happen, you would need to provide proof that you have, in the court of law, legally divorced this person. Furthermore, if you and your spouse share a mortgage, it will likely be discussed during the divorce proceedings. However, you would still need to approach the mortgage company to ensure your ex-spouse’s name is removed. Again, this will require proof, in the form of your divorce papers, to show that this change can be done legally. Finances If you and your former spouse shared a checking or savings account, you will need to provide certified copies of your divorce records in order to remove their name from the account. Without this, their name cannot be removed and they can have access to that account and the money within it, at any time. Getting Remarried If, down the road, you choose to remarry, you will likely have to have a copy of your divorce papers. Many states require you to show proof, if you have been previously married, that the dissolution of marriage (divorce) has taken place, legally. Yes, you are probably wondering why, we keep saying “Legally”. The reason is that it is extremely important, especially in society today, that you divorce your spouse in the court of law. Just saying you are divorced does not represent the fact. In Conclusion As you can see, it is very important that you obtain copies of your divorce record. These copies should be obtained from the county clerk, in the area in which you obtained your divorce, and they must be “certified copies”. Certified copies means that it must be signed by a public notary and the county seal must be placed upon it. If neither of these exists, no one will accept the divorce papers as legal proof. Other reasons to obtain certified copies of your divorce papers include changing your name on your social security card, as well as your driver’s license, and insurance purposes as well, to remove a spouse or change a name.
